1. Introduction

These Terms of Service ("Terms") govern your use of DivorceCompanion web application and services ("Service"), operated by DivorceCompanion Ltd ("we", "us", "our"). By accessing or using DivorceCompanion, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Nature of Service

2.1. Assisted DIY Digital Platform

DivorceCompanion is an assisted DIY digital platform for people managing their own divorce and financial settlement in England and Wales. We combine process guidance, practical resources, and digital document-preparation tools — including a Consent Order Online, Form E Online, and Form D81 Builder — so you can prepare your own paperwork and reduce what you spend on professional help. We are not a law firm and we do not replace a solicitor; where your case requires legal advice, you should instruct a qualified solicitor, and our tools are designed to complement that advice rather than substitute for it.

2.2. Not Legal Advice

We do not provide legal advice. All content, guides, and information on DivorceCompanion are for educational and informational purposes only and do not constitute legal advice.

2.3. Your Responsibility

You are solely responsible for:

Deciding whether to seek independent legal advice from a qualified solicitor
The accuracy and legality of any documents you prepare
Compliance with court procedures and deadlines
The legal consequences of your decisions

3. Your Obligations

3.1. Honest Disclosure

In any family court proceedings, full, frank, and clear disclosure of your financial circumstances is required. Deliberately hiding assets or providing false information to the court is a serious offence (contempt of court) and can lead to criminal penalties. DivorceCompanion is not liable for any user who uses the Service to conceal information.

3.2. Independent Legal Advice

Whether you need legal advice depends on your case, and seeking it is at your discretion. Everyone can act as a litigant in person, but if your case calls for it — for example, it is complex or contested — we recommend that you obtain independent legal advice from a qualified SRA-regulated solicitor before entering into any financial settlement or submitting documents to court.

4. Payment and Refunds

4.1. Fees

Fees for bundles and tools are payable at point of purchase. Prices are inclusive of VAT unless stated otherwise.

4.2. Refund Policy

We offer a 30-day money-back guarantee on bundle purchases. You are eligible for a full refund provided you have not downloaded the near-complete or final version of your document — once you have downloaded the final, court-ready document, the purchase is considered delivered and is no longer refundable. To request a refund, contact us within 30 days of purchase and confirm how you found the Service not useful. We will process your refund in accordance with our Money-Back Guarantee policy.

5. Limitation of Liability

5.1. Cap on Liability

To the maximum extent permitted by law, our total liability to you for any claims arising out of or related to these Terms or the Service is limited to the amount you paid to us for the Service.

5.2. Exclusion of Damages

We shall not be liable for:

Any loss of assets, financial settlements, or spousal maintenance resulting from your court case
Any costs incurred for legal advice or solicitor fees
Indirect, consequential, or special damages
Court rejection of documents due to content, missing attachments, or procedural errors

6. Data Security

6.1. Data Encryption

We use industry-standard encryption to protect your data both at rest and in transit. However, no internet transmission is 100% secure.

6.2. Data Deletion

You may request deletion of your account and data at any time via your account settings. Once deleted, your data cannot be recovered.

6.3. Marketing Communications

By creating an account you agree to our terms of use and to receive occasional product updates and tips by email. You can unsubscribe any time via the unsubscribe link in any email, by replying to any DivorceCompanion email with the word STOP, or by emailing hello@divorcecompanion.co.uk. Transactional emails relating to your account, purchases and ongoing divorce process (for example, verification, receipts and stage-specific guidance) are not marketing communications and continue regardless of your marketing preferences.

7. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
